Mrs. Freitag, a resident of Green Lake county, died September 1, 1958, at the age of seventy-three or seventy-four as a result of injuries received in an automobile accident while riding as a passenger with the appellant. She left her surviving the appellant, with whom she lived for about a year prior to her death, and two daughters, Mrs. Lorinda Solverson, the respondent, who resided in Illinois, and Helen Champagne, of Milwaukee, Wisconsin. The purported will which left everything to the appellant and made him executor without bond, was executed by the deceased on April 22, 1958, at St. Agnes Hospital, Fond du Lac, Wisconsin, where she was taken following another automobile accident in which she was injured as a passenger in the appellants car.
