Action in the St. Louis County District Court for death by wrongful act brought by Willard C. Peterson, trustee for the heirs of Cynthia S. Peterson, who allegedly died as the result of the negligence of Harry G. Johnson, deceased. Milan S. Balach, special administrator of the estate of said decedent, was named as defendant. The case was tried before Patrick D. OBrien, Judge, and a jury, and at the close of plaintiffs evidence, the court granted defendants motion for a directed verdict. Plaintiff appealed from the judgment entered and from an order denying his motion for a new trial.
